What’s the difference between a California & Federal Apostille?

A Secretary of State issued Apostille and those coming from the Federal Department of State both cary equal weight as far as their status and certification. The true difference is that they verify signatures of different public officials.

Depending on the document that you have, we will need to evaluate which agency your documents need to go through and the Country you are needing these documents processed for.

Whose signatures can be Apostilled and Authenticated?

The California Secretary of State will Authenticate documents that bear the signatures of public officials including:

  • Notary Public
  • Court Deputies & Court and County Clerks
  • Department of Justice Officials
  • County Recorders & FBI Officials
  • Criminal Identification Specialist (DOJ)
  • Superior Court Judges

What about Countries not part of the Hague?

Countries that are not part of the Hague Convention of 1961 are indeed eligible for an Authentication however they must go through a few different steps on the path to final Legalization. Fortunately we do have the infrastructure in place to assist you in every step of this process. Typically the process involves an Apostille at the State level, an Authentication at the Department of State, and then ultimately the Legalization of a given document at the Countries Embassy. Apostille (pronounced “ah-po-steel”) is a French word meaning certification. An Apostille or Authentication is simply the name for a specialized certification issued by the Secretary of State. An Apostille is affixed to your original document to verify an official’s signature is authentic so it can be accepted for use in Countries that are party to the Hague Convention.
